Logos and No-gos: High Court delivers for Interflora

Comment on the much-anticipated ruling from the High Court in the 'Google AdWords' dispute between Interflora and Marks & Spencer.

The judgement helps interpret recent CJEU guidance as to when the various recognised functions of a trade mark will be adversely affected, the protection to be afforded to trade marks with a reputation and, in particular, provides useful guidance as to when use of AdWords may constitute trade mark infringement.
